The federal appeals court decided on Tuesday that it would reexamine the case concerning the executive power with an larger panel of eleven justices. The judicial body also overturned a earlier ruling from a three-judge panel that had supported the administration.

Legal Saga Over Troop Deployment

This legal directive represents the latest turn in a long-running legal battle over whether the administration has the legal right and justification to deploy national guard forces in the city. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was initiated in response to ongoing demonstrations.

Conflicting Arguments

The federal government has argued that federal officials at the ICE facility in south Portland were facing threats, while city and state officials assert that local officers have control of the situation.

Contrary to characterizations of the city as a conflict zone, locals have been posting footage of lush hiking trails and a thriving food scene, and planning activities such as an protest bicycle event against the increased military presence.

Court Proceedings

The appeals court decision came after a federal judge in Portland issued two temporary restraining orders this period – one blocking the federalization of the Oregon national guard, and another stopping the deployment of any military personnel in the state, after efforts to circumvent the first order by mobilizing troops from California.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – permitting control of state troops – but the second ruling remained in place, blocking the physical sending of the forces.

En Banc Review

The latest ruling means the issue will be heard “en banc” – with both rulings under review simultaneously – by a panel of 11 judges.

“This ruling demonstrates that the truth matters and that the courts are working to hold this administration accountable. The founding document limits the executive authority, and local populations cannot be treated as a testing site for unchecked federal authority,” stated the state attorney general in a statement.

“The judicial body is sending a definite signal: the executive leader cannot dispatch the military into US cities without cause. We will continue protecting Oregon’s laws, principles, and sovereignty as this legal proceeding moves forward and our fight continues in the courts.”
